These Terms of Use ("Terms") govern your access to and use of the Snap Eat mobile application (the "App") and related services (together, the "Service"), provided by Snap Eat: AI Calorie Counter, owned and operated by KIM THIEN VU NGUYEN ("Snap Eat," "we," "us," or "our").

Please read these Terms carefully. By downloading, accessing, or using the App, you agree to be bound by them. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Snap Eat. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. The Service

Snap Eat uses artificial intelligence to estimate the calories, macronutrients, and ingredients in food based on photos you submit. The Service also provides meal logging, progress tracking, personalized messages, and related features.

We may add, change, or remove features at any time. We may also set limits on certain features or restrict access to parts of the Service without notice or liability.

3. Health and Accuracy Disclaimer

This section is important. Please read it.

  • Snap Eat is a wellness and informational tool only. It is not a medical device, and it does not provide medical, nutritional, or dietary advice, diagnosis, or treatment.
  • All calorie, macronutrient, and ingredient figures are estimates generated by artificial intelligence. They are approximate and may be inaccurate. Estimates can vary based on photo quality, lighting, portion size, hidden ingredients, and other factors.
  • You should not rely on the Service for medical decisions or to manage any health condition. Always consult a qualified healthcare professional before making changes to your diet, especially if you have a medical condition, eating disorder, allergy, or other health concern.
  • We make no guarantee regarding the accuracy, completeness, or reliability of any estimate or information provided by the Service.

You use the Service and rely on its outputs at your own risk.

4. Your Account

To use certain features, you may need to create an account. You agree to provide accurate information and to keep your login credentials secure. You are responsible for all activity that occurs under your account. Notify us promptly at peakstateworkshop.com if you suspect unauthorized use.

5. Subscriptions and Payments

5.1 Paid Features

Snap Eat may offer paid subscriptions that unlock additional features. Pricing and what is included are shown in the App before you purchase.

5.2 Billing Through Apple

Subscriptions are sold and billed through the Apple App Store. Payment is charged to your Apple ID account at confirmation of purchase.

5.3 Auto Renewal

Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours before the period ends, at the then current price.

5.4 Managing and Canceling

You can manage or cancel your subscription anytime in your Apple ID account settings. Cancellation takes effect at the end of the current billing period.

5.5 Refunds

Purchases are handled by Apple and are subject to Apple's refund policies. We generally cannot issue refunds directly. Refund requests must be made through Apple.

6. User Content

6.1 Your Content

"User Content" means the photos, meal logs, notes, and other material you submit to the Service. You retain ownership of your User Content.

6.2 License to Us

By submitting User Content, you grant us a worldwide, non exclusive, royalty free license to host, store, process, display, and use that content solely to operate, provide, and improve the Service for you, including sending it to our AI providers for analysis as described in our Privacy Policy. We do not claim ownership of your content and do not use your meal photos for advertising.

6.3 Your Responsibility

You represent that you have the right to submit your User Content and that it does not violate any law or the rights of others.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Submit content that is illegal, infringing, or harmful.
  • Attempt to reverse engineer, decompile, or extract the source code of the App, except where permitted by law.
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems.
  • Use automated means to access the Service or scrape data without our permission.
  • Resell, sublicense, or commercially exploit the Service without our written consent.

8. Intellectual Property

The App, including its design, software, text, graphics, logos, and the Snap Eat name and brand, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non transferable, revocable license to use the App for your own personal, non commercial use, subject to these Terms. All rights not expressly granted are reserved.

9. Third Party Services

The Service relies on third party providers, including cloud hosting, AI analysis, and the Apple App Store. Your use of those services may be subject to their own terms. We are not responsible for the acts, omissions, or content of third parties.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non infringement. We do not warrant that the Service will be uninterrupted, error free, secure, or that any estimate or output will be accurate.

To the maximum extent permitted by law, we disclaim all warranties regarding the Service.

11. Limitation of Liability

To the maximum extent permitted by law, Snap Eat: AI Calorie Counter and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the Service, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or fifty US dollars (50 USD).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Snap Eat: AI Calorie Counter and its affiliates from any claims, damages, losses, and expenses, including reasonable legal fees, arising from your use of the Service, your User Content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if you violate these Terms. You may stop using the Service and delete your account at any time. Provisions that by their nature should survive termination, including ownership, disclaimers, and limitations of liability, will survive.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law rules. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in California, unless otherwise required by applicable law.

15. Apple Specific Terms

Because the App is distributed through the Apple App Store, the following applies:

  • These Terms are between you and Snap Eat: AI Calorie Counter, not Apple. Apple is not responsible for the App or its content.
  • Apple has no obligation to provide maintenance or support for the App.
  • Apple is not responsible for any product warranties, claims, or losses related to the App.
  • Apple and its subsidiaries are third party beneficiaries of these Terms and may enforce them against you.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you through the App. Your continued use of the Service after changes take effect means you accept the revised Terms.
